The Compliance Monitoring Scheme (the CMS Scheme) was established by CMM 2010-03 Conservation and Management Measure for Compliance Monitoring Scheme and was implemented in 2011, 2012, 2013, 2014 and 2015 as an initial trials. A further revised Conservation and Management Measure for Compliance Monitoring Scheme CMM 2015-07 (338.88 KB) will be implemented during 2016 and 2017.

30 August 2017 is the date specified in CMM 15-07 for CCMs to provide clarifications, amendments or corrections as necessary on the draft CMR, as well as to identify particular causes for compliance issues.
Where applicable, a CCM may also submit a Capacity Development Plan or an Investigation Status Report with their draft CMR to the Secretariat (before 30 August 2017). Suggested checklist for 2017 Reporting Requirements in CMMs and other decisions
There are a number of reporting requirements that are embedded in CMMs or other WCPFC decisions, which oblige CCMs to submit information or data to the Secretariat during 2017. The Secretariat has prepared an updated checklist to assist CCMs with quickly identifying these requirements (694.79 KB)(65.85 KB).
Review of CMS in 2017
At WCPFC13, the Commission approved the Terms for a Review of the Compliance Monitoring Scheme (CMS) (WCPFC13 Summary Report, paragraph 142 & Attachment H) (130.28 KB). The objective of the review is to assist CCMs to improve compliance with the Convention and CMMs and to this end the review will be forward looking and provide clear recommendations on how best to implement the CMS. The CMS Review Panel was appointed on 18 April 2017.

WCPFC11 undertook its fourth annual review of compliance by CCMs with Commission obligations. TCC10 developed a Provisional Compliance Monitoring Report covering all CCMs against obligations in seven categories as per paragraph 3 of CMM 2013-02.

WCPFC10 undertook its third annual review of compliance by CCMs with Commission obligations. TCC9 developed a Provisional Compliance Monitoring Report covering all CCMs against
obligations in five categories as per paragraph 3 of CMM 2012-02.

Compliance was evaluated in five CMR categories (catch and effort limits; catch and effort reporting; spatial and temporal closures and restriction on the use of FADS; observer and VMS coverage; and provision of scientific data through AR Part 1 and scientific data to be provided to the Commission). One of three compliance ratings was assigned (implemented, not applicable, potential implementation issues). Four CCMs could not be assessed due to lack of submitted information.
At WCPFC9, the Commission agreed that until such time as the Compliance Monitoring Scheme becomes a permanent measure, the compliance status of any CCM or information regarding compliance developed through the Compliance Monitoring Scheme shall only be used consistent with paragraphs 1 and 6 in CMM 2011-06 and to support the continued development and refinement of the CMS, and will not be used by CCMs for any outside purpose.
During the initial trial period of the CMS Scheme, a number of challenges and difficulties were encountered which the Commission will need to address both by amending the framework of the Scheme established in CMM 2010-03, and by developing additional guidelines to aid in the implementation of the Scheme.
The CMS Scheme will evolve over time, and the process and format that was used to prepare the 2010 Report will need significant improvement and development and does not in any way constitute a precedent for the future operation of the Scheme. In 2011, the Commission ‘learned by doing’ and developed formats, processes and criteria to give effect to the provisions of CMM 2010--03 in an ad hoc fashion. It is recognized that the process will need to be further refined.
In March 2012, in accordance with CMM 2010-03 the Commission adopted a Compliance Monitoring Report that includes:
- A Compliance Status for each CCM (in accordance with Annex I to CMM 2010-03); and
- Recommendations for any corrective action needed, based on non-compliance identified with respect to that CCM.
The 2010 Compliance Monitoring Report (166.78 KB) was developed using the time and information that was available, which didn’t include information from all possible sources in this first year of implementation. In future years it would be useful if additional information were available to enable some issues to be more comprehensively evaluated (for example, observer and VMS data). The further development of the Commissions Information Management System is a necessary precursor to this occuring.
